Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the PERFORMIQ website, online courses, video training, digital learning resources, assessments, certificates and any related services (together, the “Services”). PERFORMIQ (“PERFORMIQ,” “we,” “us,” or “our”) provides structured online education in the field of tattoo artistry. By creating an account, purchasing a program, or otherwise accessing the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Who may use the Services

You must be at least eighteen (18) years of age to purchase or enrol in any PERFORMIQ program. Tattoo practice is subject to strict age and licensing requirements in most jurisdictions, and our educational content is intended for adults pursuing or practising the craft. By using the Services you represent and warrant that you are at least eighteen years old, that the information you provide during registration is accurate and complete, and that you have the legal capacity to enter into these Terms. If you are accessing the Services on behalf of a studio, school, or other organization, you represent that you have authority to bind that entity to these Terms.

2. Accounts and access

When you enrol, you may be given access credentials tied to your individual account. Your enrolment is personal to you. You agree to keep your login details confidential and to notify us promptly of any unauthorised use of your account. You are responsible for all activity that occurs under your credentials. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared, resold, or used to distribute our content beyond the scope of the licence granted below. Access to purchased programs is provided for your ongoing personal use; where a program is described as lifetime access, this means access for the operational lifetime of the Services and does not create a perpetual obligation independent of PERFORMIQ continuing to offer the program.

3. Licence to use course content

Subject to your compliance with these Terms and payment of all applicable fees, PERFORMIQ grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and view the course materials for your own personal, educational and professional development. All course videos, workbooks, templates, stencils, value charts, anatomy transfers, written materials, graphics, branding, and the arrangement and presentation of the Services are owned by PERFORMIQ or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, download other than as offered through the platform, record, screen-capture, republish, distribute, publicly display, sell, licence, or create derivative works from any part of the Services.

4. Acceptable use

You agree not to misuse the Services. In particular, you agree that you will not: circumvent, disable, or interfere with security features of the platform; use automated means to scrape or harvest content; upload malicious code; impersonate another person; harass instructors or other learners; or use the Services for any unlawful purpose. We may remove content, restrict features, or terminate access for conduct that we determine, in our reasonable discretion, violates these Terms or is harmful to other users, to us, or to third parties.

5. Educational purpose only

The Services provide education and instruction. They are not a licence, certification, apprenticeship registration, or permit to practise tattooing. Completing a PERFORMIQ program and receiving a certificate of completion demonstrates that you have engaged with our curriculum; it does not authorise you to tattoo members of the public. You are solely responsible for understanding and complying with all laws, health regulations, bloodborne pathogen requirements, licensing rules, and local ordinances that apply to tattooing in your jurisdiction before you practise on any person. 6. Purchases, pricing and taxes

Prices for programs are displayed in United States Dollars and are subject to change. The price applicable to your purchase is the price displayed at the time you complete checkout. You are responsible for any taxes, duties, or similar charges imposed by your jurisdiction. Details of billing, accepted payment methods, and invoicing are set out in our Payment and Billing Policy, and details regarding cancellations and refunds are set out in our Cancellation and Refund Policy. Each of those policies is incorporated into these Terms by reference.

7. Certificates and assessments

Certain programs include a final assessment and, upon successful completion, a documented certificate of completion issued by PERFORMIQ. We reserve the right to withhold or revoke a certificate where we determine that an assessment was completed fraudulently or that the Terms were violated. Certificates reflect completion of our educational content only and carry no accreditation status unless expressly stated.

8. Intellectual property and feedback

All trademarks, logos, and brand elements displayed in the Services are the property of PERFORMIQ or their respective owners. Nothing in these Terms grants you any right to use them without prior written permission. If you send us suggestions, ideas, or feedback about the Services, you agree that we may use that feedback without restriction or obligation to you.

9. Third-party services

The Services may rely on or link to third-party platforms, including payment processors and hosting or streaming providers. Your use of those services may be governed by separate terms, and we are not responsible for the content or practices of third parties. We do not endorse and are not liable for any third-party products referenced within our educational content, including tattoo equipment or supplies.

10. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PERFORMIQ disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular result, skill level, income, or professional outcome will be achieved. Your progress depends on your own practice, aptitude, and circumstances.

11. Limitation of liability

To the fullest extent permitted by law, PERFORMIQ and its owners, employees, instructors and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for any injury or damage arising from your practice of techniques learned through the Services. Our total aggregate liability arising out of or related to the Services will not exceed the amount you paid to us for the specific program giving rise to the claim during the twelve (12) months preceding the event.

12. Indemnification

You agree to indemnify and hold harmless PERFORMIQ and its owners, employees, instructors and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your use of the Services, your violation of these Terms, or your practice of tattooing.

13. Suspension and termination

We may suspend or terminate your access to the Services at any time for a material breach of these Terms. Upon termination, the licence granted to you ends and you must cease using the Services. Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of Kentucky and the applicable laws of the United States, without regard to conflict-of-law principles. You agree that any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Kentucky, unless otherwise required by applicable law.
